Lifetime Hosting Offer – Terms and Conditions
By purchasing our Lifetime Hosting package, you agree to the following terms and conditions. These terms are intended to protect both our business and customers by clearly defining the scope and limitations of this offer.
1. Definition of “Lifetime” Hosting
The term “lifetime” refers to the operational lifetime of the hosting company or its hosting infrastructure. In the event of a significant change in technology or infrastructure, the company reserves the right to migrate customers to comparable hosting solutions. If the company ceases to provide hosting services (e.g., due to a shutdown, acquisition, or merger), this lifetime offer will terminate. However, the company may offer an alternative or similar lifetime hosting offer in the future.
2. Scope of Services
The Lifetime Hosting package is limited to the features and resources as specified in the original offer. Changes to these features or resources may be subject to additional charges and may not be covered under the lifetime package. The company reserves the right to modify, update, or discontinue certain features, services, or technologies offered under the lifetime hosting plan, provided that comparable alternatives are made available.
3. Service Availability and Uptime
While we strive to provide reliable and consistent service, the Lifetime Hosting package does not guarantee 100% uptime or uninterrupted service. Downtime due to scheduled maintenance, upgrades, or unforeseen technical issues may occur. We do not offer a Service Level Agreement (SLA) with this package; therefore, compensation for downtime is not provided. However, we aim to maintain 99.9% uptime for all customers.
4. Transfer of Service
Lifetime hosting packages are non-transferable except in cases of significant life changes, subject to company approval. Such transfers must be requested in writing and are evaluated on a case-by-case basis.
5. Service Upgrades and Changes
Customers may upgrade their hosting plan or switch to a different hosting package at the current retail rate. The lifetime offer is only applicable to the specific package originally purchased and does not extend to upgrades or add-ons. Additional resources can be purchased at the current rates, but this does not alter the original lifetime offer.
6. Company Rights and Termination of Service
The company reserves the right to terminate this lifetime hosting agreement under the following conditions:
- Violation of the terms of service, including but not limited to illegal activities, abuse of resources, or non-compliance with company policies.
- In the event the company discontinues hosting services or undergoes a significant business change (e.g., acquisition, merger, or closure), the lifetime hosting agreement will terminate. In such cases, we will make reasonable efforts to offer comparable solutions.
7. Resource Usage Limits
The Lifetime Hosting package is subject to fair use policies. Excessive resource usage that negatively impacts server performance may result in service restrictions or termination, as determined at the sole discretion of the company. Customers exceeding resource limits may purchase additional resources at standard rates.
8. Data Backups
We provide daily backups as part of the lifetime hosting package. However, the customer is ultimately responsible for ensuring that they maintain their own backups of their data. The company is not liable for any data loss or corruption.
9. Prohibited Activities
Customers agree not to engage in activities that violate the company’s Acceptable Use Policy, including but not limited to spamming, hosting illegal content, or engaging in activities that could harm the company’s infrastructure. Violation of these policies may result in immediate termination of the lifetime hosting package without refund.
10. Compliance with Laws
Customers are responsible for ensuring that their website content and activities comply with all applicable laws and regulations. The company reserves the right to suspend or terminate services if illegal activities are detected.
11. Indemnification
Customers agree to indemnify and hold the company harmless from any claims, damages, or legal expenses arising out of their use of the hosting services, including but not limited to violations of intellectual property rights, illegal activities, or data breaches.
12. Refund Policy
All sales for the Lifetime Hosting package are final. Refunds are not provided. However, if the service is deemed non-performant within the first 30 days, the company may, at its sole discretion, offer a partial or full refund.
13. Limitation of Liability
The company shall not be held liable for any damages, including but not limited to loss of data, business interruption, or any other indirect, special, or consequential damages arising out of the use or inability to use the services offered under the Lifetime Hosting package.
14. Transfer or Sale of Business
In the event of a business transfer or sale, the company will make reasonable efforts to honor the lifetime hosting agreement. However, the new owner may choose to continue, modify, or terminate the agreement at their discretion.
15. Force Majeure
The company shall not be liable for any failure or delay in performing its obligations due to circumstances beyond its control, including but not limited to natural disasters, pandemics, governmental actions, or acts of terrorism.
16. Automatic Account Closure for Inactivity
Accounts that are inactive for a period exceeding 12 months may be subject to termination. Customers will be notified prior to account closure, allowing them to reactivate their service. Reactivation fees may apply.
17. Support Limitations
Support for Lifetime Hosting customers is limited to basic technical support. Advanced support requests, such as complex website issues or consulting, may incur additional fees. These services are provided on a case-by-case basis and are not included in the Lifetime Hosting package.
18. Changes to Terms and Conditions
The company reserves the right to update or modify these terms at any time. Customers will be notified of any significant changes to the terms, and continued use of the services after such changes constitutes acceptance of the updated terms.
19. Customer Responsibilities
By using HubSeek’s hosting services, customers agree to the following responsibilities to maintain the security and integrity of their data and hosting accounts:
- Data Backups: While HubSeek provides daily backups as part of the lifetime hosting package, customers are ultimately responsible for maintaining their own off-site backups of all data. HubSeek is not liable for any loss of data, and customers should ensure that they have adequate backup solutions in place.
- Security Measures: Customers are responsible for securing their websites, data, and access credentials. This includes but is not limited to:
- Using strong, unique passwords for hosting accounts and restricting access to trusted individuals.
- Monitoring their accounts for suspicious activity and immediately notifying HubSeek of any security breaches or concerns.
 
- Software Updates: Customers must keep all software, applications, plugins, and scripts up to date. Outdated software can introduce security vulnerabilities that may compromise the hosting service, and customers are solely responsible for ensuring that their systems remain secure.
- Malware and Hacking: HubSeek provides security tools like BitNinja as an additional layer of protection, but customers are responsible for protecting their sites against hacking attempts, malware, and viruses. HubSeek is not liable for damages resulting from malware infections, security breaches, or hacks.
- Resource Usage: Customers must ensure that their use of resources (such as CPU, memory, and bandwidth) remains within the limits set by their hosting plan. Excessive or improper resource usage may result in performance degradation, service suspension, or additional charges.
- Compliance with Laws: Customers are responsible for ensuring that their use of HubSeek’s hosting services complies with all applicable laws and regulations. This includes, but is not limited to, data privacy laws, intellectual property laws, and content restrictions as defined in the Acceptable Use Policy.
